Abstract

The modern world has entered a new era in the existence of international law, when the seemingly stable system of its norms is in a state of crisis. This crisis is associated with a whole range of contradictions caused by objective trends in the existence of international actors and a reassessment of the values of the emerging unipolar world.

The article is devoted to a comprehensive knowledge of the essential aspects and problematic issues of the legal status of maritime zones, which can be established by states in the context of an armed conflict at sea. It is pointed out that the law of armed conflicts, also known as international humanitarian law, being a branch of public international law, regulates the conduct of hostilities, the use of weapons, the protection of victims during international and non-international armed conflict (jus in bello). It is rooted in customary law and is in dialectical interaction with it.

The characteristics of the armed conflict at sea, its functional properties and influence on the international legal norms governing this kind of legal relationship are considered. The legal status of maritime zones in the law of armed conflicts at sea has been studied. The paper lays an original way of understanding the complex issues of application of the norms of international maritime law and international humanitarian law in their totality through their functional correlation with the conditions and consequences of an armed conflict at sea. It is noted that the allocation of maritime zones in the law of armed conflicts at sea is one of the most problematic issues that requires the consolidated efforts of participants in international relations, in the joint concentration of which the level of real legal development, democracy, legality and humanism are manifested.
